An investigation into the accident has been launched after charges were dropped against the 25-year-old officer. The investigation will look into how the case was treated by Lothian and Borders Police who admitted that no breath test was carried out on the officer following the crash.
The claimant and her husband were about to go home after celebrating New Year when the father-of-three was hit by the policeman as he crossed the road to get a takeaway. There were over 50 New Year partygoers who witnessed the accident.
The police officer had finished a shift at the capital's Drylaw police station shortly beforehand. Following the accident he drove away from the scene but returned seven minutes later.
Unfortunately the victim died in Edinburgh Royal Infirmary a few hours later as a result of serious internal injuries.
The widow has now launched a road traffic accidentcompensation claim against the police officer but insists the claim is about getting justice for her husband and their three children.
