Employee wins neck injury claimsA former soldier who served both in the first Iraq war and during the conflict in Kosovo has secured whiplash compensation for an injury he sustained while passenger in his employer's van. The 44-year-old whiplash compensation claimant was passenger in his employer's Ford Transit van when the renovation specialist who was driving lost control of the vehicle and smashed it into a wall. Both men sustained bruising and neck and spinal injuries accident – although, the claimant's solicitor suggested that the car accident could have been much worse and that both men "were lucky to be alive". However, as only one vehicle was involved in the incident and accident investigators found no evidence of any kind of road defect, only the passenger will receive whiplash compensation. The case had been due to go to court for a hearing but was settled out-of-court after the defendant's lawyers conceded liability and their willingness to pay 100% compensation. Settlement includes sums for lost earnings, pain and distress and loss of enjoyment, particularly as the injured man is a keen amateur football player who once had trials with leading clubs and went on to represent the army. The claimant's no win, no fee solicitor remarked that his client was happy with the outcome of the whiplash compensation claim.
