Whiplash sufferers in crash angered by policeman's dropped charges
Following a car accident in Torquay that wrote off a car and left its occupants with whiplash injury earlier this year, a policeman charged with dangerous driving has been acquitted and walked free, reported the Western Evening Post this weekend.
The officer also faced charges of drink-driving, which were thrown out when evidence drawn from a blood-test taken from the man was ruled inadmissible after arguments were heard from his lawyer.
The Crown Prosecution Service argued that all had been done in line with current best practice, but Brake, an anti-road traffic accident charity, said, "Too many drivers being investigated for serious driving offences are having their cases dropped due to errors by police in collecting evidence."
The driver and passenger in the other car involved in the crash were angered by the result, saying, "I just feel very upset with the whole process.
"Only 15 minutes earlier we had our four-week-old grandson in the car but luckily we had just dropped him home. We both suffered whiplash and the car was a complete write-off."
*A replacement vehicle can usually be supplied within 4-6 working hours, where there is an admission of liability from the other person’s insurance company. If this person is not known, their insurance details are not known, they are uninsured or there is a potential dispute over who caused the accident, a replacement vehicle cannot be provided.
