US SMS-related car crashes to be reduced by Schwarzenegger ban
Californian car crashes involving drivers on mobile phones should be reduced in 2009, as Governor Arnold Schwarzenegger has just brought in a law making texting at the wheel illegal.
Schwarzenegger said, "Banning electronic text messaging while driving will keep drivers' hands on the wheel and their eyes on the road, making our roadways a safer place for all Californians."
In those cases where SMS-related road traffic accidents still occur, despite the ban, it is likely that a driver shown to be in breach of the law will face greater liability in any trial or personal injury claim that results.
A survey by legal site Findlaw found that 75 percent of American drivers admitted sending or receiving a text whilst driving. No figures were available as to how many car crashes were caused by this activity.
*A replacement vehicle can usually be supplied within 4-6 working hours, where there is an admission of liability from the other person’s insurance company. If this person is not known, their insurance details are not known, they are uninsured or there is a potential dispute over who caused the accident, a replacement vehicle cannot be provided.
