Landmark UK damages ruling after man's Spanish car accidentA landmark court judgement in favour of a man from Bristol means he is a step nearer gaining full compensation for a car accident in Spain and sets a standard to help people who suffer in similar incidents. The pedestrian was left with disabling personal injuries after he was hit in a car park by an uninsured driver while on holiday in Marbella with his partner and three sons in 2007. He was initially told he was only entitled to Spanish levels of damages for his injuries, which included a broken pelvis and multiple leg fractures, rather than under the UK system taking allowance of his future needs and loss of earnings. Originally, a High Court judge agreed with the Motor Insurance Bureau that because the crash happened in Spain that country's rules applied but, after a three-year campaign by the victim's PI solicitors, the Court of Appeal has issued a pioneering ruling that the family is entitled to British standards of recompense. The man, who formerly ran a building company, does not yet know how much he will receive when the legal procedures are completed. Other holidaymakers and visitors who suffer in similar accidents in Europe can now expect any future injury claims after a vehicle accident to be dealt with on the same basis.
