Roadworker's car accident case settled out-of-court
The family of a highway worker who died almost three years after a car hit him at the side of the road have reached an out-of-court settlement with the insurers of the driver involved.
The council employee suffered severe traumatic brain injury after being hit by a Ford Escort while he set up roadwork signs in July 2003.
The man spent nearly three years in a nursing home having not regained consciousness, but died in February 2006.
Criminal charges were not brought against the driver of the car; however, the roadworker's family started a civil case against the driver's insurers.
After considerable time, the insurers have now accepted partial responsibility for the driver's part in the accident.
The man's sister said, "The entire family are pleased someone has finally accepted responsibility for Tony's accident. "When we began civil proceedings we were not interested in compensation, this has always been about finding out what happened."Tony was never able to tell us what happened on that day and now we feel the final piece of the puzzle has been found."The family was assisted in the car accident compensation case by personal injury solicitors and GMG – Britain's General Union.
*A replacement vehicle can usually be supplied within 4-6 working hours, where there is an admission of liability from the other person’s insurance company. If this person is not known, their insurance details are not known, they are uninsured or there is a potential dispute over who caused the accident, a replacement vehicle cannot be provided.
