Car accident victim awarded £3.5m in out-of-court settlement
A man who received horrific personal injury as a passenger in a car crash has received £3.5m in an out-of-court settlement of the case.
The 23-year-old victim was a back seat passenger in April 2004 when the car he was travelling in was involved in a road traffic accident with another vehicle in Leicestershire.
He suffered severe brain injuries leaving him blind in one eye, partially sighted in the other and his cognitive abilities have been affected.
On behalf of her son, the man's mother made a car accident compensation claim against the driver at fault, but as her son was not wearing a seatbelt at the time of the accident the insurers agreed to pay 85% of the full valuation of his claim.
A trial was set to determine the total value of the award.
However, before final settlement terms were decided, it was agreed in London's High Court that the man should receive a lump sum to cover the cost of medical care for the rest of his life.
The judge approved the out-of-court settlement which included a sum of £25,000 for the man's mother, in recognition of the care she has given to her injured son.
The car accident compensation had already provided an interim payment of £696,000, deductible from the £3.5m lump sum, that has enabled the family to buy a new home in which to care for the young man.
