Car accident victim will not get payout say insurers
A man crushed during an accident where the vehicle driver suffered a heart attack at the wheel has launched a campaign to secure car accident compensation for the victims of such "freak occurrences".
The 47-year-old, father-of-two has been left unable to drive and in constant pain after the car driver's Volvo collided with him. The driver later died in hospital from a heart condition that he was unaware of.
As a result of this, the driver's insurers say he was neither negligent nor liable and therefore they have refused to pay any compensation for the car accident.
The car accident victim said, "It's unbelievable insurance companies can get away with this knowing someone has been permanently disabled.
"I fractured both my knees and despite an operation and 11 months physiotherapy I've still got serious mobility problems. I can't walk long distances and my driving is restricted. Four years down the line, it's not got any better.
"I've never been able to go back to work in the chemical industry, where I had 25 years' experience. It has turned my life upside down.
"I just want compensation to be available to people in situations like this, so they don't have to endure the hardship I have."
His MP, Dr Iddon of Bolton South-East, has called for a new law that would force insurers to contribute to a fund of money that would pay car accident compensation to victims of incidents such as this.
*A replacement vehicle can usually be supplied within 4-6 working hours, where there is an admission of liability from the other person’s insurance company. If this person is not known, their insurance details are not known, they are uninsured or there is a potential dispute over who caused the accident, a replacement vehicle cannot be provided.
