A 26-year-old Canadian woman has received $45,000 in whiplash compensation, but has had a claim for a separate $850,000 in compensation for persistent headaches turned down.
The North Vancouver resident initially made her road accident claim in 2001 after colliding with another vehicle while driving her parents’ car out of a busy car park.
Although the claimant received physiotherapy treatment for her whiplash, she claims that she has developed persistent and debilitating headaches as a result of the crash.
Her road accident claim writ had claimed that these headaches had prevented her from successfully completing her studies and had disadvantaged her on the job market. However, the judge hearing the case found there was no evidence to substantiate this, so only awarded the claimant compensation for her whiplash.
In addition to the $45,000 personal injury compensation award, the judge has also instructed the 26-year-old’s no win, no fee solicitor to negotiate with the defendant’s legal team so that they can establish a sum of damages covering the former student’s medical expenses.
