A cyclist who sustained brain damage in a car accident in September 2007 has been granted permission to pursue a claim for road traffic accident compensation.
The 23-year-old man sustained severe personal injury after colliding with a taxi at a junction in Bedford. As a result of the accident he launched a claim for compensation against the driver of the vehicle.
However, the driver disputed the claim, since despite going over the 30mph speed limit at the time of the incident he claimed that the cyclist was also to blame as he went through a red light.
The case appeared at London's High Court where the Judge determined that the taxi driver speeding was not the primary cause of the accident and that a contributing factor was that the cyclist went through red lights.
It was ruled that the cyclist has permission to seek road traffic accident compensation against the driver's insurers but will only be eligible for 20% of the value.
