A 21-year-old cyclist who was hit by a car four years ago when he was stopped by the side of an A-road has been told he will receive car crash compensation.
However, the judge hearing the case ruled that the Swindon-based claimant will not receive 100% car crash compensation as he was partially responsible for the accident.
"He could and should have realised that, given the absence of light or light clothing, he was standing in an exposed location," the judge commented.
Adding, "He was substantially responsible for the accident and should bear a greater share of the responsibility for his injuries."
As a result the claimant, who was sending a text message to his mother at the time of the accident, will only receive 45% car crash compensation for his injuries. Despite this, the personal injury solicitor representing the 21-year-old can expect to secure a six-figure settlement.
