A 69-year-old woman in America is attempting to make a car crash claim against the manufacturer and seller of a child car seat she says is responsible for the death of her four-year-old great grandson.
No win, no fee lawyers acting for the claimant have lodged a car crash claim writ against Dorel Juvenile Corporation, Kmart Holding Corporation, Sears Holdings Corporation and the deceased boy's mother; she was driving when, for reasons perhaps related to icy roads and difficult weather conditions, she lost control of her truck, causing the boy to suffer fatal injuries.
The lawyers argue that Kmart and Sears should be held liable on the grounds that they sold the seat knowing "it was in an unreasonably dangerous and inherently defective condition."
The claimant argues that she has suffered physical and mental pain and suffering as a result of the death.
It is not known how much car crash compensation the claimant is hoping to obtain.
