Appeal Court win
An Appeal Court decision has cleared the way for a 23-year-old man to receive 100 percent car accident compensation for the brain injury he sustained in a 2003 incident in South Yorkshire.
A judge at London's Civil Appeal Court ruled that, although the claimant had not been wearing a seatbelt at the time of the crash, this could not be considered grounds for contributory negligence, as it is likely he would have received similar injuries even if he had been wearing a seatbelt.
The ruling means that no win, no fee solicitors representing the man can begin work on negotiating a 100 percent car accident compensation settlement on his behalf.
He was just 16 and a front seat passenger at the time of the crash, but now suffers from serious cognitive dysfunction, including poor concentration, reduced memory and "inappropriate and obsessional behaviour, disinhibition, impulsivity and verbal aggression".
It is anticipated that the man's 100 percent car accident compensation payout may reach a seven-figure sum.
