Personal injury compensation is available
for people who have been injured in a non-fault car accident
involving uninsured or hit and run drivers. If the car
accident involved an uninsured or untraced driver, personal
injury compensation will need to be obtained through an organisation called the Motor Insurers’ Bureau.
There are literally thousands of car accidents
each year involving uninsured or untraceable drivers. Whilst this means that there is no insurance company to make a

The Motor Insurers’ Bureau (MIB) is an independent body set up to compensate people who have
been involved in car accidents with negligent untraced or
uninsured motorists. Through the scheme, which is funded by UK insurance companies, it is possible to claim both personal injury compensation and damage to your vehicle following a
non-fault car accident (subject to a number of conditions).
An injured person has three years from the date of the car accident in which to make a claim to the MIB. If
the claim is for vehicle damage only, it must be submitted within 9 months of the car accident date.
An injured person must report the car accident
to the police within 14 days of it taking place and in the case of vehicle damage, within 5 days of the incident.
An acknowledgement must be obtained from the police, quoting a crime reference number. The applicant
is also expected to fully cooperate with the police during their investigations
Uninsured drivers
An application for personal injury compensation and property
damage can be made to the MIB if the driver of the other vehicle was uninsured, but identified at the time of the
accident. The MIB will make investigations to establish whether or not the uninsured driver was infact responsible
(liable) for causing the accident and they will seek to obtain evidence to support the value of the claim. This will
include medical records in relation to injuries and documentary evidence relating to loss of earnings, property and
vehicle damage.
If the MIB’s decision on liability or the amount of any award is not satisfactory then an
appeal can be made to reconsider any accident claims.

Untraced Drivers

damage to vehicles cannot be recovered in hit and run cases. The MIB will need to establish that the untraced driver was
responsible (liable) for causing the accident and they will seek to obtain evidence to support the value of the claim,
including medical records in relation to injuries and documentary evidence relating to loss of earnings and any other
losses being claimed, prior to making an award. If the MIB’s decision on liability or the amount of any award is
